FDA’s graphic labeling of tobacco products

On February 29, DC District Judge Richard Leon overturned a lower Court’s decision allowing the FDA’s graphic labeling of tobacco products. Saying the marketing was unconstitutional, Judge Leon said “the Court concludes that these mandatory graphic images violate the First Amendment by unconstitutionally compelling speech,” read his decision. The Justice Department is appealing the injunction which stopped the FDA from enforcing the stronger labeling practice.
